Terms and conditions of participation

Scope of application, obligations and costs
(a) These terms and conditions apply when people take part in the competition organized by Snom Technology GmbH (Aroser Allee 66, 13407 Berlin, Germany). 

(b) Participation is free of charge and without obligation for the participants. Likewise, the chances of winning are not influenced by any services provided by the participants. 

Eligibility to participate
(a) Participation is open to natural persons aged 18 and over who are resident in an EU member state.  

(b) Employees of Snom Technology GmbH and their family members are excluded from participation. 

Rights of third parties
(a) Participants declare that their submission to the competition (e.g. texts, drawings or photographs) does not infringe the rights of third parties, in particular copyrights and personal rights. 

(b) If other persons were involved in the creation or development of the entry, they must agree to its submission and subsequent publication as part of the competition. The same applies if third parties have been granted an exclusive right to the submitted entries. Even if persons are recognisable in submitted photographs or drawings, their consent must be obtained for submission and subsequent publication. 

Processing
(a) Participation is free of charge and independent of the purchase of goods or services. By participating in the competition, you accept the conditions of participation of Snom Technology GmbH. 

(b) Competition mechanism: Snom Technology will draw a prize every day among the participants of the post of the respective day. 

(c) The prize draw takes place in the period 01-24 December 2023. 

(d) Participants in the competition are people who like or comment on the post on the social media pages mentioned below on the specific day. Depending on how the call to action is defined on the specific day. 

(e) Later likes and comments will no longer be considered in the prize draw, regardless of the reason for the delay. Snom Technology GmbH cannot be held responsible for any technical faults, in particular failures of the telephone network, network, electronics or computers. 

(f) The following applies to all competitions in social networks: Participants may not promise any monetary or other benefits for recommending their comments, posts, likes or tweets. If this does happen, the participant may be excluded from the competition.  

(g) If bots or like fraud are used to evaluate the participant's own comments, posts, likes or tweets, the participant may also be excluded from the competition. 

(h) Payment of the prize in cash, in kind, its exchange or transfer to other persons is not possible. A winner may relinquish their prize. In this case, the next person will take his/her place or another winner will be chosen under the existing conditions. The prize will generally be delivered by post to the address provided by the winner. If it is not possible or unreasonable to hand over the prize, the winner will receive an equivalent replacement. 

(i) Notification of the prize will be sent directly by Snom Technology GmbH. Snom Technology GmbH is authorised to transmit the winner's data to the shipping partners in order to enable delivery of the prize. 

(j) The winner must confirm receipt of the prize notification to Snom Technology GmbH immediately, but at the latest within 7 days, and provide the required information. Otherwise, Snom Technology GmbH is authorised to draw a new winner. 

(k) In the event of unsuccessful postal delivery of the prize, Snom Technology GmbH reserves the right to select a new winner. If the contact details provided are incorrect (e.g. postal or e-mail addresses), Snom Technology GmbH is not obliged to search for correct addresses. Any disadvantages resulting from the provision of incorrect contact details (e.g. incorrect postal or e-mail address) shall be borne by the participant. 

(l) The item presented as a prize in the competition is not necessarily identical to the item won. In fact, there may be deviations in terms of model, colour or similar. The prize sponsor may select an item of medium type and quality equivalent to the item presented as a prize. 

(m) Please note that Snom products do not function on their own and must generally be integrated into a telephone system or structure in order to function fully. 

(n) Snom Technology GmbH is not responsible for delivery damage. 

Data protection information on the competition

(a) Data will be protected in accordance with the statutory provisions (see privacy policy).  

(b) Participants agree that their submissions to the competition and the personal data submitted (first name, city, country, photograph or other electronic materials) may be published on the Snom Technology GmbH website in connection with the competition, its draw and processing. 

(c) Snom Technology GmbH is authorised to transmit the winner's data to the shipping partners in order to enable delivery of the prize. 

(d) Participants may object to the publication of their personal data at the time of participation or subsequently. 

Liability

(a) Snom Technology GmbH shall only be liable - irrespective of the legal grounds - if damage has been caused by culpable breach of a material contractual obligation (cardinal obligation) in a manner that jeopardises the achievement of the purpose of the contract or is due to intent or gross negligence. If Snom Technology GmbH is liable in accordance with the above paragraph for the breach of an essential contractual obligation without intent or gross negligence, the liability is limited to the extent that Snom Technology GmbH could typically expect at the time of conclusion of the contract based on the facts known to them at that time.  

(b) The above limitations or exclusions of liability shall not apply in the event of culpable injury to life, body and health, for liability claims under the Product Liability Act and in the event of a contractually agreed no-fault obligation or if the relevant circumstance giving rise to liability was fraudulently concealed.  

(c) Insofar as the liability of Snom Technology GmbH is excluded or limited in accordance with the provisions of this exclusion of liability, this also applies to the personal liability of executive bodies, employees, representatives and vicarious agents. 

Changes to the rules of participation and termination of the competition

(a) Snom Technology GmbH reserves the right to change the conditions of participation at any time.  

(b) Furthermore, Snom Technology GmbH reserves the right to terminate or interrupt the competition or prize draw at any time for good cause without prior notice. This applies in particular to reasons that would disrupt or prevent the competition or prize draw from proceeding as planned. If such a termination is caused by the behaviour of a participant, Snom Technology GmbH is entitled to demand compensation from this person for the damage incurred. 

(c) In exceptional cases, special conditions of participation apply, which will be clearly indicated for the respective competition. In the event of conflict, they shall take precedence over these general terms and conditions. 

Additional conditions

(a) Further conditions of participation (e.g. duration of the competition, type and scope of the prize) are specified in the respective competition.  

(b) Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. They shall be replaced by an appropriate provision that comes closest to the purpose of the invalid provision.
